1. Who you are contracting with
These terms govern your access to and use of the Sellrith AI platform (the "Service"), operated by Sellrith AI ("Sellrith AI", "we", "us", "our"). By creating an account, signing in, or otherwise using the Service, you agree to these terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.
2. The Service
Sellrith AI provides AI-powered tools for online sellers, including product discovery, automated listing generation, performance analytics, and multi-channel publishing. Features available to you depend on the plan you subscribe to.
3. Account & acceptable use
You must keep your account credentials confidential and are responsible for activity under your account. You agree not to:
- Use the Service in violation of any applicable law or regulation.
- Commit fraud, send spam, or engage in deceptive practices.
- Infringe the intellectual property, privacy, or other rights of any person.
- Probe, scan, scrape, reverse engineer, introduce malware, or otherwise interfere with the security or integrity of the Service.
- Resell, sublicense, or redistribute the Service or circumvent any technical limits.
When you use generative-AI features, you are responsible for your prompts, for how you use the outputs, for verifying their accuracy, and for ensuring you have the rights to any content you submit. Outputs may be inaccurate and are not a substitute for professional advice. We may remove or restrict content, refuse or filter outputs, and suspend accounts that misuse the Service (including for illegal content, deepfakes, hate speech, malware, or jailbreaking attempts). Repeated rights-holder complaints may result in termination.
4. Intellectual property
Sellrith AI and its licensors retain all right, title, and interest in the Service, including all software, documentation, branding, and underlying technology. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with the plan you have purchased. You retain ownership of the content you submit and grant us a limited license to host and process it solely to provide the Service. We provide a takedown pathway for rights-holder complaints; please contact support@sellrith.ai.
5. Payment, subscriptions, and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. See our Refund Policy for details.
6. Service availability
We work hard to keep the Service reliable, but we do not guarantee uninterrupted or error-free performance. The Service is provided "as is" and, to the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
7. Suspension & termination
We may suspend or terminate your access to the Service if you materially breach these terms, fail to pay amounts due, pose a security or fraud risk, or repeatedly or seriously violate our policies. On termination you may lose access to your account data; we will provide a reasonable export window where practical before deletion.
8. Liability
To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid to us in the twelve months before the event giving rise to the claim. We are not liable for indirect, consequential, incidental, or special damages, including loss of profits, revenue, data, or goodwill. Nothing in these terms excludes liability for fraud, death, or personal injury where it cannot be excluded by law.
9. Indemnity
You agree to indemnify and hold Sellrith AI harmless from claims arising out of content you submit, your unlawful use of the Service, or your breach of these terms.
10. Changes
We may update these terms from time to time. Material changes will be communicated through the Service or by email. Continued use after the changes take effect constitutes acceptance.
